Welcome to SmartBlogger. These Terms of Service ("Terms") govern your use of our website (smartblogger.io), platform, and related services. By accessing or using our service, you agree to be bound by these Terms.

These Terms constitute a legally binding agreement between you and Cognitobit Innovations Private Limited ("Cognitobit", "we", "our", or "us"), the owner and operator of the SmartBlogger platform. If you do not agree, please do not use our service.

"Service" refers to the SmartBlogger platform, website, and all related features (sites, content generation, publishing, rotation, credits). "User" or "You" refers to any individual or entity using our Service. "Account" refers to your account for accessing the Service. "Content" includes data, text, and materials you create or that we generate for you via the Service.

3. User Accounts

You must provide accurate information when creating an account and maintain the security of your credentials. You must be at least 18 years old (or have legal capacity). You are responsible for all activity under your account. Notify us at anuj@cognitobit.com of any unauthorized use.

4. Acceptable Use Policy

You agree NOT to use our Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property or other rights of third parties

You are responsible for ensuring your content complies with applicable search engine policies and any third-party platform rules.

We may suspend or terminate accounts that violate these terms or that harm the Service or other users.

5. Intellectual Property Rights

SmartBlogger is a product of Cognitobit Innovations Private Limited. All rights in the platform, design, documentation, and branding belong to Cognitobit. You retain rights to your sites and your content. By using the Service, you grant us a limited license to host, process, and operate the Service for you (e.g. publishing, linking, rotation).

6. Privacy and Data Protection

Our collection and use of your personal information is governed by our Privacy Policy. We do not sell your personal information. We implement reasonable security measures and retain data as described in our policies.

Our use of Google Search Console (GSC) data (when you choose to connect it) is also governed by the Privacy Policy.

7. Pricing, Payment & Refunds

Use of the Service is subject to the pricing and credit system described on smartblogger.io. Unused credits may roll forward as stated in your plan. Payments are processed via our payment providers. All fees are generally non-refundable; we may make exceptions at our sole discretion (e.g. billing errors). We may change pricing without advance notice. You are responsible for applicable taxes.

If you purchase a subscription, it will generally renew automatically at the end of each billing period unless you cancel before renewal (as shown in your billing portal).

8. Service Availability

We strive for high availability but do not guarantee uninterrupted or error-free access. We may perform maintenance or modify features with reasonable notice where practicable.

9. Termination

You may terminate your account at any time. We may terminate or suspend your account if you breach these Terms, harm the Service or others, or fail to pay fees. Upon termination, your access will cease; provisions that by nature should survive (e.g. liability, dispute resolution) will remain in effect.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE LESSER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100 USD.

11. Indemnification

You agree to indemnify and hold harmless Cognitobit and its affiliates from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights or laws.

12. Dispute Resolution and Governing Law

Before filing a lawsuit, you agree to attempt informal resolution by contacting anuj@cognitobit.com. These Terms are governed by the laws of India (Haryana). Any disputes shall be resolved in the competent courts in Rewari, Haryana, India. You waive any right to participate in class actions against us.

13. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes via the website or email. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.
